The tax landscape for trusts and estates is changing dramatically, and many traditional Form 1041 strategies may no longer work under the new “One Big Beautiful Bill Act” (OBBBA). The OBBBA significantly reshapes fiduciary tax planning for 2026 through 2029, creating new challenges and opportunities for estate and trust practitioners.
In addition, the IRS has introduced major revisions affecting Form 1041 preparation, including changes impacting fiduciary income taxation, trust distribution planning, the State and Local Tax (SALT) deduction, and increased compliance scrutiny for estates and trusts.
Practitioners who continue using outdated 2025 distribution models may expose clients to missed tax-saving opportunities, unnecessary tax liabilities, or costly Schedule J throwback rule consequences.
